If after sueh hearing the noard is of the opinion that the amount claimed is too high, and that the amount which should be rllowed is more than should be expended for that portion of the highway, it may if practicable alter the propbsed highway so as to avoid the particular property in question. Miller appeared before i-f. board of county commis- under Section 4 of Article 16 of the Constitution, rnd Section 1S66 of the 1920 Wyoming Compiled Statutes, that it is unlawful to expend money for any purpose unless there is a prior appropriation therefor, and unless the expenditure of such money is within the anticipated taxes for county purposes for the current year. I am advised that your annual budget was prepared in accordance with law in January 1927, and that at the time of its preparation you made an estimate of anticipated taxes for county purposes for the current year 1927.

I have examined this budget and find that no appropriation was made for air port facilities, and of course such appropriation could not have been made at the time the budget was prepared because you could not anticipate that the legislature would enact Section 5 of Chapter 72 of the 1927 Session making it possible to expend county funds for such, purposes, such statute being enacted February 26, 1927. From an examination of the annual budget prepared in January 1927 it is observed that a considerable sum of money was set apart for miscellaneous expenditures. In view of the above facts, and the law applicable to the-situation, it is impossible for you to legally expend any money for air port purposes unless such moneys are expended from the miscellaneous funds. Of course I do not know if you have expended all the funds appropriated for miscellaneous purposes at this time. If you have not it would be entirely legal for you to exend moneys for air port purposes from such fund appropriated for miscellaneous purposes.

May I also direct your attention to Section 1613 of the 1920 Wyoming Compiled Statutes, which provides that any indetedness created in excess of the debt limit provided in Section 4 of Article 16 of the Constitution, and for the payment of which there are no available revenues, shall be void, and that any officer who shall participate in creating such indetedness, and the sureties on his official bond, shall be personally liable to the holder or holders of such indebtedness as fully as if such indebtedness had been for his individual benefit.
